By requesting a quote, placing an order, scheduling a consultation, making a purchase, accepting delivery or installation, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, you must not use our services.

These Terms apply to all customers, whether individuals, businesses, contractors, designers, or organizations, and supplement any written proposal, estimate, invoice, statement of work, purchase order, or service agreement issued by Maple Crest Furnishings Ltd.

Any renderings, drawings, samples, swatches, photographs, catalog images, or design concepts are provided for illustrative purposes only and may not precisely reflect final results, finishes, textures, colors, grain patterns, or measurements.

3. User Obligations and Responsibilities

You agree to:

  • Provide accurate, current, and complete information when placing orders or requesting services;
  • Promptly review and confirm all quotations, measurements, specifications, and design approvals;
  • Ensure the installation site is safe, accessible, and suitable for delivery, assembly, and/or repair work;
  • Obtain all required permissions, landlord approvals, building access, elevator bookings, permits, or other authorizations needed for service performance;
  • Protect floors, walls, doorways, fixtures, and surrounding areas as necessary, unless otherwise agreed in writing;
  • Be present, or designate an authorized representative, at scheduled delivery, installation, or consultation appointments where required;
  • Inspect products and services promptly upon delivery or completion and report any issues within a reasonable time; and
  • Use products in accordance with manufacturer instructions and customary care practices.

You are responsible for any delays, additional costs, or damages arising from inaccurate information, site inaccessibility, failure to prepare the premises, or failure to provide timely instructions or approvals.

You must not misuse our website or services, engage in fraudulent activity, interfere with our operations, or violate any applicable law or third-party rights.

4. Payment Terms and Conditions

Unless otherwise stated in writing, all prices are quoted in Canadian dollars (CAD) and are subject to applicable taxes, shipping charges, delivery fees, installation fees, customs duties, levies, environmental handling charges, and other applicable costs.

We may require a deposit, milestone payment, or full prepayment before commencing work, ordering materials, reserving inventory, or scheduling delivery. Custom orders, special orders, and made-to-order items may be non-refundable once materials are procured or production has begun.

Payment is due according to the invoice terms provided. If no payment timeline is specified, payment is due upon receipt. Late payments may result in:

  • Suspension or delay of services;
  • Cancellation of orders;
  • Storage charges for undelivered items; and/or
  • Interest on overdue amounts at the maximum rate permitted by applicable law.

You authorize us, or our third-party payment processors, to charge the payment method you provide for all amounts due, including authorized deposits, balances, fees, adjustments, and applicable taxes.

Any dispute regarding an invoice must be raised in writing within a reasonable period after receipt. Undisputed amounts must still be paid on time.

5. Cancellation and Refund Policy

Cancellation requests must be submitted in writing to our contact information set out below. Cancellations are subject to the terms of the applicable quote, invoice, or service agreement.

  • Custom or made-to-order items: Once production has started, materials have been ordered, or work has commenced, cancellations may not be accepted and deposits may be forfeited to the extent permitted by law.
  • Standard stock items: Cancellations may be available before shipment or delivery, subject to restocking or administrative fees where applicable and permitted by law.
  • Delivery and assembly services: Cancellations or rescheduling requests made with insufficient notice may incur fees to cover labour, travel, and scheduling costs.
  • Repair and refinishing services: Work already completed, materials already used, or custom finishes prepared specifically for your order are non-refundable.

Refunds, if approved, will generally be issued using the original payment method within a reasonable period after approval, subject to inspection, return of products, and deduction of any lawful charges, including shipping, handling, restocking, or repair costs.

Where a product is defective, damaged in transit, or materially non-conforming, we may, at our option and as permitted by law, repair, replace, re-perform, or refund the affected item or service. Any such remedy is subject to reasonable notice and verification.

6. Liability Limitations

To the fullest extent permitted by applicable Canadian law, Maple Crest Furnishings Ltd. shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of business, loss of data, loss of use, or loss of goodwill, arising out of or related to our services, products, or these Terms.

Our total aggregate liability for any claim arising out of or relating to a specific product or service shall not exceed the amount paid by you for that product or service in the 12 months preceding the event giving rise to the claim, or the minimum amount required by law, whichever is greater.

We are not responsible for:

  • Damage caused by misuse, improper installation by others, neglect, or failure to follow care instructions;
  • Pre-existing structural issues, hidden defects, or unsafe conditions at the delivery or installation site;
  • Natural variations in wood, fabric, leather, stone, metal, or other materials;
  • Delays caused by suppliers, carriers, weather, labour shortages, or events beyond our control; or
  • Minor variations in dimensions, color, finish, or texture that are within normal industry tolerances.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for gross negligence, wilful misconduct, fraud, or any non-excludable statutory warranty or consumer right.

If a force majeure event occurs, we may suspend performance, extend deadlines, or modify or cancel affected services as reasonably necessary. We will make commercially reasonable efforts to resume performance as soon as practicable.

10. Changes to Terms

We may update or revise these Terms from time to time in our sole discretion. Changes will be effective upon posting the updated Terms or otherwise communicating them to you, unless a later effective date is stated.

Your continued use of our services after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our services.

For orders already accepted, the Terms in effect at the time of acceptance will generally apply to that order unless a change is required by law or expressly agreed otherwise in writing.

11. Applicable Law and Jurisdiction

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
